TERMS OF SERVICE
By using Fotovan’s services, website, or booking platform, you agree to be legally bound by the terms set forth in this Agreement. We reserve the right to update or modify these terms at any time. Continued use of our services constitutes acceptance of any changes. If you do not agree to these terms, please do not use our services.
ACCOUNT & BOOKING
An account is required to book services through our platform. By creating an account, you agree to provide accurate contact and billing information.
SERVICE AREA
Fotovan provides services in select markets as listed on our website. Properties located outside our active service areas may require a special reservation. If your property falls outside our service area, you may submit a request through our booking platform and our team will follow up.
PROPERTY PREPARATION
It is important that your property be ready for our team when we arrive. Your appointment includes an allotted amount of time for the session. Properties are photographed and filmed as-is, so we recommend the following to ensure the best results:
Remove all personal and personally identifiable items (family photos, diplomas, certificates, etc.)
Ensure every room is clean and free of clutter
Move vehicles, trash cans, garden hoses, and other items from exterior areas
Clear the exterior of weeds and debris
Confirm that all interior and exterior light bulbs are in working order
Proper preparation ensures a timely and efficient session and helps us deliver the highest quality content for your listing.
PAYMENT
Full payment is required at the time of booking. We accept credit card and check payments. Checks should be made payable to Fotovan. A $25 fee applies to all returned checks. Content will not be released until payment has been received in full. Net-30 invoicing is available for qualifying clients by request. Clients approved for Net-30 terms will be invoiced after services are rendered, with payment due within 30 days of issuance. Please ensure you receive a confirmation email with your booking details before exiting the booking platform.
CANCELLATION & RESCHEDULING
All cancellations and reschedules are subject to our Cancellation & Rescheduling Policy, which can be viewed at fotovan.com/cancellation-policy.
CONTENT OWNERSHIP & USAGE
All photographs, videos, and other content produced by Fotovan remain the intellectual property of Fotovan. Upon receipt of full payment, the client is granted a perpetual, non-exclusive license to use the delivered content for the purpose of marketing the photographed property. This license does not transfer copyright ownership. Fotovan reserves the right to use delivered content for portfolio, marketing, and promotional purposes.
LIABILITY & PROPERTY ACCESS
The client is responsible for ensuring safe and timely access to the property for all scheduled appointments. Fotovan is not liable for property damage, theft, loss, or any issues arising from property access, including but not limited to lockbox malfunctions, missing keys, or unsecured premises. By booking a session, the client confirms they have authorization to grant Fotovan access to the property. Fotovan’s total liability for any claim arising from services rendered shall not exceed the total amount paid by the client for the specific session in question.
GOVERNING LAW
This Agreement shall be governed by applicable law. Any disputes arising from this Agreement or the use of Fotovan’s services shall be resolved through good-faith negotiation before pursuing formal legal action.
